What must be marked on cosmetics OEM processing packaging

Update:2021-12-30
Summary:

The cosmetics label is the identity card of cosmetic products. According to the standard GB5296.3-2008 "Instructions for Use of Consumer Products-General Labels for Cosmetics", the editor has compiled the contents that must be marked on the cosmetics label for everyone.

The name of the cosmetic: should be concise and easy to understand, reflecting the true attributes

It usually consists of brand name + common name + attribute name, for example: Yumeijing + moisturizing + cream.

1. Trademark name. Both registered trademarks and unregistered trademarks can be used, but they need to comply with the relevant provisions of my country's trademark laws and regulations. The Trademark Law stipulates that enterprises, undertakings and individual industrial and commercial households "who need to obtain the exclusive right to use a trademark shall apply for registration with the Trademark Office." This shows that whether it is necessary to obtain the exclusive right to use a trademark is up to the user of the trademark to decide. If you do not need to obtain exclusive rights, you do not need to register. Unregistered trademarks are allowed to be used, but they are not protected by law.

2. Common name. It can be words that indicate the main raw materials of the product or describe the purpose of the product, the purpose of use, the location of use, etc., and the words that express or imply medical effects must not be used.

When raw materials or functional ingredients are used as the common name, they must be the raw materials and ingredients contained in the product formula; if a product has multiple functions at the same time, multiple functional terms are allowed to exist at the same time; but if a product has two functional ingredients at the same time , Such as propolis extract and XX polysaccharide, if the common name shows propolis polysaccharide, it is inappropriate and ambiguous, so that users do not know whether it is two components of propolis and XX polysaccharide or whether the product contains propolis polysaccharides. . If the two functional ingredients are used together, there should be no ambiguity.

3. The attribute name. Indicate the real physical properties or appearance, such as cream, cream, water, liquid, powder, etc.

The common name and attribute name can be omitted for some customary and customary cosmetic names. Such as eye shadow, lipstick, facial mask, conditioner, etc.

The Chinese names of imported cosmetics should correspond to foreign names as far as possible, and free translation, transliteration, etc. can be used. The similar foreign characters or other symbols shall be explained in Chinese on the visible side of the package.

Special attention: Except for registered trademarks, the pinyin and foreign fonts used in the logo shall not be larger than the corresponding Chinese characters.

The name and address of the producer

1. The domestic cosmetics producer, that is, the party responsible for the quality of the product, can be the direct producer or the organizer of the manufacturing activity. When labeling the address of the producer, in principle, it must be consistent with the domicile of the company’s "business license".

If it is a producer who commissions the production or processing of cosmetics, there are different labeling methods according to whether the commissioning company has a production license:
Example: Client: A company name
Address: Address A
Entrusted party: Company B
Address: B address

Or use the responsible person/dealer to distinguish the relationship between the entrusting party and the entrusted party.

2. Imported cosmetics: Imported cosmetics sold in China must be marked with the name of the country or region of origin (referring to Hong Kong, Macau, Taiwan) and the name and address of the agent, importer or distributor legally registered in China. It is not necessary to mark the name and address of the producer.

The above name and address should be marked on the visible surface of the sales package.

3. Net content

Generally marked according to the state of cosmetics:
Special note: For cosmetics whose content is expressed by counting, the three Chinese characters "net content" can be exempted, and tablets, sheets, pieces, etc. can be used directly as the unit of counting.

The net content should be marked on the display surface of the cosmetics sales package. If it cannot be marked, it can be marked on the visible surface.

Cosmetic ingredient list

The quality of raw materials in cosmetic formulations is an important factor affecting the safety of cosmetics. The addition of different raw materials brings different effects (including cleaning, moisturizing, fragrance, and conditioning) to cosmetics.

All raw materials shall specify the standard Chinese name, raw material serial number, restricted substance content, purpose of use, etc., and shall not conceal deliberately added ingredients, or label ingredients that do not actually have.

The ingredient list on the label should be guided by "Ingredients:".

1. The labeling order of the ingredient names: should be in descending order of the added amount. For each ingredient with an added amount greater than 1%, the ingredients in the product ingredient table should be arranged in the order of decreasing ingredient added amount in the product formula. The remaining ≤1% of the ingredients can be arranged arbitrarily after the ingredients greater than 1% are arranged in descending order, without descending order.

2. For the mixture, the ingredients before mixing should be marked separately: for example: a mixture of titanium dioxide coated with triethoxyoctyl silane in a sunscreen product.
The above-mentioned raw material is composed of 2% triethoxyoctyl silane and 98% titanium dioxide. It is added to the formula at 8.84%. When the full ingredients are marked, two ingredients need to be marked separately, and the order needs to be calculated. What is the amount of total ingredients: Triethoxyoctylsilane: 2%*8.84%=0.1768%; Titanium dioxide: 98%*8.84%=8.6632%. Therefore, the above-mentioned raw material summary titanium dioxide content in the formula composition is 8.6632%. If the formula still contains the same raw materials, they must be added and sorted, and then the full composition table will be arranged in descending order.

3. Labeling of the components of the extraction solution: The extraction solution should be labeled with the extract, the extraction solvent and the dilution solvent remaining in the extraction solution, respectively. For example:
According to the above table, it can be concluded that the content of the avocado tree (BUTYROSPERMUM PARK II) fruit fat extract in the raw material is 0.2%, water is 92.8%, butanediol is 5.0%, and 1,2-hexanediol is 2.0%.

The addition amount of the raw material in the formula is 1%, and the amount of each ingredient in the raw material in the formula can be calculated separately: avocado tree (BUTYROSPERMUM PARKII) fruit fat extract: 0.2%*2%=0.004%; water: 92.8% *2%=1.856%; Butanediol: 5.0%*2%=0.1%; 1,2-Hexanediol: 2.0%*2%=0.04%. For example, the content of the above-mentioned ingredient water in the formula table is 1.856%. If the formula contains the same raw materials, they must be added and sorted, and then the full ingredient table will be arranged in descending order.

3. Indication of the composition of the combined package product: For packaged products, such as milk and cream that need to be used in conjunction, the product composition table should be listed separately. For products with multiple colors of the same package in the same package, such as four-color eyeshadows, the ingredient labeling of this type of product can be a summary of the four-color eyeshadow formula and label it in the form of an ingredient list, or according to the 4 ingredient lists. Label.

4. For colorants, they have other functions at the same time, and they can be marked separately according to the purpose of use, or they can be marked after being combined. Conventional use: when titanium dioxide is used as a sunscreen, it is labeled as "titanium dioxide", and when it is used as a colorant, it is labeled as "CI 77891"; when mica is used as a general matrix material, it is labeled as "mica"; and as a colorant When it is marked as "CI 77019".

5. The ingredient name to be marked should adopt the ingredient name in "International Nomenclature of Cosmetic Ingredients (INCI) Chinese Translation". If the ingredient name contains Latin literature name, the Latin part does not need to be marked in the ingredient list, such as: rye (SECALE) CEREALE) seed extract can be directly marked as: rye seed extract when labeling.

There are two ways to mark the shelf life:

1. Production date and shelf life: For example, the production date is marked: "production date 20160515" or the production date is shown on the package, and the packaging is marked 20160515; the shelf life is marked: "shelf life*year" or "shelf life*month".

2. Production batch number and expiration date: The production batch number can be numbers and/or letters and/or Chinese pinyin and/or text, such as the second batch produced on January 15, 2007, with the epitope 200701152; or using "sequential date" "(Become julian code abroad) for labeling, that is, directly use 3 digits to indicate that the product was produced on the first few days of a certain year. The expiration date should be marked with guiding phrases such as "please use before the date marked" or "see packaging for expiration date" or "expiration date". For example, the date should be clearly marked in the order of year, month, and day: 20160515.

Other content that should be marked

1. The production license number of the enterprise and the product standard number should be marked.

2. Imported non-special cosmetics preparation text number for the standard: National Makeup Preparation J******.

3. Special cosmetics should be marked with the approval number: national makeup special character G******.

4. Mark the words of safety warning: use "Caution:" or "Warning:" as the guiding language.

The contents that must be marked on cosmetics have been summarized. In order to avoid detours when making cosmetics labels, cosmetics companies please comply with GB5296.3-2008 "Consumer Instructions on Cosmetics General Labeling" and "Cosmetic Labeling Management Regulations" (Order No. 100), etc. Laws and regulations.
